在設計的過程中，參考他人作品中的思想或要素進行創作，為設計中常見的創作方式，但始終讓設計者百思不得其解的是：這樣的創作方式，是否會有侵權的問題？然而，著作權侵權之實務判決上，侵權比例不明確及其高深莫測的法官心證，讓人難以捉摸，故著作權侵權為本研究探討之核心，侵權是否有確切之成立定義或準則，能有一套更具體之認定標準及程序，乃本研究之目的。

2014年與視覺設計相關的著作權侵權案件共有38件，本研究以此38案為研究樣本，進行案例分析，敘述每一案例之判文內容，解析法院判斷侵權之方式與其心證及判決之結果，並輔以我國著作權法規與著作權相關之文獻檢驗分析38個視覺設計著作權侵權案例，分析侵權之判斷模式及程序，並從中找出相同或相異之處。

研究分析之結果，提出六項研究之結論：一、著作權侵權之認定要件；二、著作權侵權之判斷方式；三、侵權判斷之接觸與實質相似；四、最易涉及侵權之權利及其行為；五、著作權侵權判斷之狀況；六、著作權侵權構成之要素。

由研究結果提出之建議：一、建議我國法院於侵權的判決上，能更詳加細敘其判決之心證，且能有一套更具體之判斷程序；二、應於高中職階段訂定著作權課程，提升學生著作權的基本觀念。

並列摘要 〈TOP〉 Numerouscasesofinfringementonvisualdesigncopyrightshavecometolightinsociety,andregardlessofwhethertheyinvolvecompleteplagiarismorcreativeextensionsofthethinkingorkeyelementsinothers'works,allofthesecaseshaveagreattendencytobecomemiredindisputesconcerningwhethertheyviolatetheCopyrightAct.Inthedesignprocess,creativityreferringtothethinkingorkeyelementsinothers'worksisacommonlyseenapproachtocreativework,butalsoforcesdesignerstograpplewiththedifficultquestionofwhetherthistypeofcreativeapproachwillleadtoinfringementproblems.Nevertheless,inpracticaljudgmentsconcerningcopyrightinfringement,theinfringementratiohasbeenunclear,andjudges'obscureandcomplexmentalimpressionscanbeunfathomabletoothers.Asaconsequence,thisstudyfocusesontheissueofcopyrightinfringement,andhasthegoalofdeterminingwhetherasetofmorespecificidentificationstandardsandprocedurescouldenablethederivationofunambiguousdefinitionsorguidelinesfordecidingwheninfringementhasoccurred. Thetotalof38visualdesigncopyrightinfringementcasesoccurringin2014serveasthisstudy'sresearchsample.Thisstudyperformscaseanalysis,describesthecontentoftheverdictofeachcase,analyzesthecourt'sapproachtodeterminationofinfringementanditsmentalimpressionandjudgmentresults,analyzesthe38visualdesigncopyrightinfringementcasesinlightofTaiwan’scopyrightlawsandregulationsandanexaminationoftheliterature,analyzesinfringementjudgmentmodelsandprocedures,andlooksforthesimilarordivergentaspectsofthesemodelsandprocedures. Thefollowingsixresearchconclusionshavebeenderivedfromtheresultsofthisanalysis: 1.Keyelementsoftheidentificationofcopyrightinfringement,2.methodsofjudgingcopyrightinfringement,3.contactandsubstantivesimilarityinjudgmentofinfringement,4.rightsandtheiractionsthatmosttendtoinvolveinfringement,5.copyrightinfringementjudgmentprocedures,and6.theconstituentelementsofcopyrightinfringement.
