他不服定罪及判刑上訴，在第二上訴人定罪上訴得直後仍維持放棄定罪上訴。

2.本席即席批准判刑上訴，現頒下理由。

案情概要 3.控罪指第一上訴人與另外三名被告人於2012年11月16日在順天邨天池樓11樓殘酷地踢一隻小貓，或因胡亂或不合理地作出某種作為而導致牠受到不必要的痛苦。

4.案發當晚約7時半，第一上訴人與5至6人（包括其他3名被告人）到達天池樓11樓以上一樓層，一名男子腳踢小貓一下，小貓逃離開該層。

數分鐘後，該班人中3至4人（包括第一上訴人）落到11樓。

他們分成兩組，分別站在1102及1104室外。

兩名男子以小貓為球，交換式踢小貓兩次，其間有男子發出笑聲。

5.小貓即口部流血、後腳癱瘓、胸部、心臟、脊椎胸椎嚴重受傷，最終需要人道毀滅。

求情理由 6.第一上訴人23歲，長於破碎家庭，自2004年期涉毒品及暴力罪行，因吸毒染上尿道炎。

裁判官的理由 7.裁判官指沒有證據顯示誰人有踢小貓，但根據當時環境，1102及1104兩室之間為一狹窄走廊，一邊是牆壁，另一邊是欄杆。

眾人分兩邊而站，形成小貓被圍封局面，無路可走，不能似在較高樓層時本能地逃走。

8.裁判官指出，第一上訴人見到小貓在樓上被踢，到樓下時沒有意圖參與的人，有機會退出，但他沒有這樣做，反映與踢貓者共同進退意圖。

9.裁判官引述上訴法庭案例SJvIuChiYung（譯音姚志容）CAAR4/2008。

該案答辯人與另外一人，一個以鐵鏟、一個以木球棒襲擊一隻黃麂約一分鐘。

黃麂流血，大聲悲鳴至失去知覺。

定罪下被判8個月監禁，因無刑事紀錄，扣減兩個月至6個月。

律政司司長申請刑期覆核。

上訴法庭指出，殘酷對待動物每宗案件情節不同，是否需要監禁及刑期取決於虐待動物的原因。

有關案情非同類最嚴重者，沒有長時間虐待動物以致受苦，施虐者從而不當地享受快感。

上訴庭拒絕加刑申請。

10.裁判官引述裁判法院案件HKSARvMokChungTing（譯音莫仲霆）TMCC3700/2012。

該被告人因狗吠而將天拿水淋在狗隻，點火燃燒，狗隻需要人道毀滅。

上訴人自首及承認殘酷對待動物罪，被判監禁8個月。

11.而在裁判處案件HKSARvANHaizhou（譯音安海周），該被告人以繩索繫着貓頸，讓貓兒奔跑，來回拉緊繩索數次，為時3、4分鐘。

最終小貓死亡，該被告人將貓屍裝好，放在公園長凳。

定罪下被判監禁3個月。

其後裁判官覆核刑期，將監禁加至7個月。

12.裁判官指出本案之加重嚴重性因素如下： (1)眾人非預謀，但亦非酒醉下犯事； (2)有多人參與； (3)小貓沒有對任何人造成危害或滋擾； (4)過程中有人嬉笑，莫視苦楚； (5)小貓並非即時死去，受苦多少時候，最終人道毀滅。

13.裁判官亦有引述屠宰狗隻的案例。

14.裁判官指出，殘酷對待動物罪最高刑期3年，本案屬中等程度級別。

裁判官指沒有特殊情況的量刑起點應為12個月，因加重嚴重因素，以18個月為起點。

第一上訴人身體欠佳，減刑兩個月，判處監禁16個月。

上訴理由 15.上訴人上訴理由為18個月監禁量刑起點明顯過重。

討論 16.代表答辯人的李大律師指出，上訴法庭沒有就有關罪行定出量刑指引，判刑應按個別案情而定，而刑期取決於有關被告人是否從施虐中得到不當的快感。

17.李大律師指出，案發時有人發出笑聲，雖然不知是誰人，但第一上訴人必定知道施虐者從中得到快感。

案發現場是狹窄走廊，上訴人站在一端，對小貓造成圍封。

他沒有退出，因此有參與成份。

18.代表上訴人的姚大律師則指出，上訴人並非腳踢小貓者，他沒有抽離，可說是有鼓勵作用，但他並非負最大罪責者。

19.本席認為，眾人圍觀貓兒被虐踢，從中得到不當的快感，但證據沒有顯示第一上訴人為踢貓者，他只夥同犯罪。

20.鑑於案情，本席將定罪下之量刑起點定為14個月監禁，考慮到上訴人之身體狀況（他有尿頻，需要經常如廁），因此將刑期減為12個月監禁。
